How To Tell If Your Neighbour Has Built Over The Boundary

How To Tell If Your Neighbour Has Built Over The Boundary

Has there been some work going on next door that has made you wonder how to tell if your neighbour has built over the Boundary? At QLD Surveying Solutions we can help you identify the exact property boundary to determine if any further action needs to be taken.

Property boundaries in Queensland can be determined with a boundary survey, which is also known as an identification survey. They can be conducted by those looking to erect a new fence or retaining wall, building a new house or even to help resolve boundary position disputes between neighbours.

In our latest blog below, we talk about what is involved in a boundary identification survey and what we uncovered during a recent survey conducted for a homeowner.

Boundary Encroachment Client Case Study

Our client approached us ahead of completing extensive renovations to their existing house in Gordon Park. Our surveying team completed a Contour & Detail Survey along with an Identification Survey, to assist with the design phase.

Project LocationBrisbane City Council

What is involved: An Identification Survey was completed where boundaries were marked with pegs/and or screws. As legally required, we then lodged the Identification Survey Plan for public record. We also completed a Contour & Detail Survey to assist the architect with the design phase of the project.

Project OutcomeOur survey showed that one side fence was not erected on the boundary and as a result, an air conditioning unit along with a timber screen structure was encroaching from the neighbour’s yard onto our client’s property.

extract identification survey

It is a legal requirement to mark any encroachments on the Identification Survey Plan and all relevant homeowners be notified.

Documentation: A copy of the Identification Survey Plan (PDF file via email) was provided to our client, along with a copy of the encroachment notice that was forwarded to their neighbour. We also supplied our client with a Contour & Detail Survey Plan (PDF file via email) along with the relevant CAD file.

Is My Fence My Boundary Line?

An Identification Survey determines the actual boundary location. It is often assumed that the property boundary is where the fence is located.

However we find a lot of fences are not erected on the actual boundary (especially in older areas).

Our client will now be able to use our survey and encroachment notice as a tool to approach his neighbour to come to an amicable solution.

Land Surveyor New Home

Land Surveyor New Home

If you’re building your forever home from scratch, you’ll need a land surveyor for a new home.

At QSS, our experienced surveying consultants can help south-east Queenslanders with a variety of services, including property surveys, construction surveys and development surveys.

Recently, we were engaged to complete a Building Set-out Survey and supply a Form 16 Certificate for a stunning home in the Scenic Rim, which was designed and constructed by Hobbs Building & Interiors.

Keep reading to find out a bit more about the surveying process and how we helped to ensure this unique home was positioned perfectly on the block.

What is a Building Set-Out?

In Queensland, a set-out survey is needed for a variety of construction projects, including any houses, carports, granny flats and renovations.

This kind of survey ensures the home is built in accordance to the approved architectural plans and is in the correct position.

It involves moving the design onto the land itself, by marking out the key points and lines, so that builders can stick to them during construction.

Building Set Out for New Home Canungra

The QSS team was proud to offer a positive contribution to the new home build at the end of the quiet Canungra cul-de-sac.

For the stunning Hobbs Building & Interiors home, QSS accurately located the property boundaries by field survey and checked against the existing survey plans.

Our team examined the supplied approved design plans to ensure they met the setback requirements. Then we uploaded the information onto a computer that allowed efficient set-out of the design in the field.

Final certification was a super smooth process for Hobbs Building & Interiors.

We confidently supplied a Form 16 Certificate to confirm that their build complied with council regulations and conditions.

Awesome outcome and smiles all round for this project!

Property Boundaries and Fences

Property Boundaries and Fences

When you’re trying to determine the location of property boundaries and fences, it’s important to call in professional surveyors, like the team at Queensland Surveying Solutions, to carry out an Identification Survey.

This type of survey, also commonly called a boundary survey, is the only way to determine where the exact property lines lie. That means it’s also helpful when neighbours disagree about the location of trees, fences and other structures.

Recently, we carried out an Identification Survey for a homeowner in Albany Creek who was concerned their neighbour’s newly-built retaining wall was encroaching onto their land.

Boundary Surveying: North Brisbane Retaining Wall

In this case, our survey showed that the retaining wall was not encroaching on the homeowner’s land.

We found the wall was on the boundary in some parts, but in other areas it was clear.

Our team was able to provide a definitive conclusion for our client by completing an Identification Survey. It also prevented any unnecessary conflict between the neighbours.

How to find the property boundary

When professional surveyors are looking to identify the property boundary, these are the steps we take:

  1. We marked the boundaries with pegs and screws.
  2. We picked up the location of the retaining wall in question.
  3. We marked the retaining wall on the Identification Survey Plan:
    • On the plan, we showed where the retaining wall was positioned in relation to the actual boundary.
  4. We then lodged the Identification Survey Plan with the Department of Natural Mines, Resources & Energy for public record. This is a legal requirement.
  5. We also provided a copy of the survey to our client.

When is an Identification Survey Useful?

It is often assumed that the property boundary is where the fence is located, however we find a lot of fences are not erected on the actual boundary (especially in older areas).

Without an Identification Survey there is no way of determining where the actual boundary is.

These surveys can help when homeowners are:

  • Erecting a fence or retaining wall,
  • Investigating an easement,
  • Resolving property line disputes with neighbours,
  • Working out if a neighbouring structure is encroaching on their land, and
  • Building an extension or any new structures on their property.

Client Case Study Bretts Wharf Riverwalk

Bretts Wharf Riverwalk is a pedestrian and bicycle, concrete, shared path suspended over the north bank of the Brisbane River at Hamilton. An existing QSS construction client approached us to assist on this project with survey works.

Here is a bit more about what was involved in the project:

Type of work being doneRevetment wall to tie in with existing walkway along the Brisbane River at Bretts Wharf, Hamilton.

Surveying works requiredPre-design Survey (Survey of existing features to assist in designing wall to required specifications).

Set out for the construction of a rock wall.

As-constructed Survey.

Project Location: Bretts Wharf Riverwalk Remediation – Hamilton, Brisbane City Council.

Project background info: The structure is 210 metres long and 4.8 metres wide and runs east from Brett’s Wharf ferry terminal. During regular maintenance inspections, council identified that a section of the riverwalk, adjacent to Bretts Wharf Apartments, required work to enhance the life of the structure and ensure that it remained safe and serviceable, without restrictions, for the benefit of users.

The Bretts Wharf Riverwalk rehabilitation project is part of Council’s Boardwalk Rehabilitation Program. This project is part of council’s commitment to improving quality of life for residents while ensuring our city has the services and infrastructure to meet the needs of future generations.

For further information please visit the Brisbane City Council website here

Project information: To improve the safety and life of Bretts Wharf Riverwalk, Council stabilised the river bank and piles that support the riverwalk.

Works involved:

  • Installing a rock armour seawall
  • Injecting cement stabilised fill and sand into the void under the deck
  • Minor repairs and replacement of the corroded under-deck reinforcements (where required).

Outcome: Our client used our survey for the design phase for critical tie ins. If our survey was not accurate, it could have resulted in a full re-design with modifications, which would have cost our client valuable time and money.

Due to the unstable ground surface of the riverbed, to ensure accuracy, we used metal star pickets.

Documentation: QSS completed and supplied our client with as-constructed plans as required.

NOTE: What are as-constructed surveys/plans?

As constructed refers to measurement of the built form. This often occurs for public infrastructure (sewers, drainage, roads etc) as well as buildings and earthworks. Delivery of as-constructed survey works is usually to a standard such as, As Constructed (ADAC), so that these measurements can be passed onto local government for maintenance. As constructed surveys are also regularly performed on buildings for compliance with building approvals or construction design standards.

With a subdivision planned in the Wynnum area, we were engaged by the developer to assist on the project with a land survey.

Here is a bit more about the project and how we contributed:

Type of surveying works being completedSubdivision – Contour & Detail Survey.

Project Location: Bay Terrace, Wynnum – Brisbane City Council.

What is involved: A Contour & Detail Survey is the first point of call when completing a subdivision. The Contour & Detail Plan is used for subdivision design to maximise the lot yield.

The plan presents information about your land for the purposes of proposed development to local council.

Outcome: This survey had a lot of features that needed to be surveyed including a creek that ran through the rear of the property.

There were lots of varying heights, ledges, retaining walls, stairs, trees and gardens that required surveying.

Attention to detail is of upmost importance when completing surveys like these to ensure that nothing is missed.

Documentation: Upon completion, a Contour and Detail Plan was forwarded onto our client, along with relevant CAD files. The plan will now accompany the Development Application (DA) to local council.

How to Subdivide Your Property

How to Subdivide Your Property

If you’re looking to downsize your parcel of land, you are probably considering the processes involved and wondering how to subdivide your property.

The team at Queensland Surveying Services have the experience and expertise to assist you.

We can support the needs of different types of projects from residential and commercial subdivisions to multi floor high rises. We assist in the approvals process, pre-construction, construction and through to settlement.

The Subdivision Process

  • A feasibility study is usually done first to determine if the proposed development would be supported by the relevant local authority (council).
  • This is usually done using the services of a town planner and perhaps meeting with council to discuss ways of achieving their acceptable outcomes.
  • If the development is feasible, then a contour detail plan is prepared and is used to determine a new lot layout and the location of new services.
  • A proposal plan is then drawn up showing the proposed new layout and submitted to council for approval in the form of a development application.
  • Operational works are next including earthworks and laying of new services. New boundaries are marked and a formal plan prepared and submitted to the Department of Natural Resources, Mines & Energy for examination.
  • The approved plan is then submitted to the relevant council once all the conditions of the DA have been met. The plan is then sealed.
  • If the local council are satisfied that the conditions have been complied with, they will sign the back of the survey plan.
  • The applicant must then submit the survey plan and all relevant legal documents to the Titles Office for registration within six months of the survey plan being sealed by council.
  • Once the survey plan is registered, new titles are created and the units/lots can be settled.

Why Choose Queensland Surveying Solutions?

  • We conduct property, development and construction surveys in civil, construction, cadastral, mining and engineering industries.

Retaining Wall Disputes

Retaining Wall Disputes
Retaining Wall Disputes

It’s not uncommon to hear about retaining wall disputes among neighbours. One of the biggest difficulties lies in determining who has responsibility for the wall.

There are many ways to go about understanding ownership of a retaining wall but one of them includes engaging a surveyor, such as Queensland Surveying Solutions, to carry out an identification survey.

To find out more about how this process can assist you, please us on 07 3325 0927 or send us an online message here.

Who is Responsible for a Retaining Wall on the Boundary?

Retaining walls are not classed as fences under the Neighbourhood Disputes Resolution Act 2011. Retaining walls are built to support built up or excavated earth. They are normally not a matter of joint responsibility for neighbours as they are usually benefit one neighbour more than the other.

This means that the person responsible for maintaining the retaining wall is usually the person who owns the property the retaining wall is located on.

How do you Know if the Retaining Wall is in Your Property?

An identification survey will help determine if the retaining wall resides on your property. Also known as a boundary survey, an identification survey is one of the most common and frequent type of surveys that we do at Queensland Surveying Solutions.

This survey needs to be completed by a registered cadastral surveyor. Its purpose is to identify exact property boundary lines and corners.

Do I Really Need an Identification Survey?

While it is a choice to have one done, an identification survey will assist homeowners or purchasers who are wanting to establish the exact location of their boundaries to assist with:

  • Erecting new fences, building new houses or extensions to existing houses
  • Erecting a new or maintaining an existing retaining wall
  • Need to see if building or other structures encroach onto their lot or vice versa
  • Resolving boundary position disputes with neighbours
  • Investigation of easements, restrictions or covenants over the land that are noted on the Title

Further information about your responsibility as a fence owner in Queensland can be found here.
